Trong vòng vài giờ sau quyết định của tòa án, công ty của chúng tôi đã nhận được rất nhiều câu hỏi từ các nhà đầu tư EB-5 tiềm năng, những người đang hy vọng có được cơ hội đầu tư vào một dự án đủ điều kiện EB-5 với mức 500.000 USD.

Thị thực đầu tư EB5 là gì?
Chương trình Thị thực Nhà đầu tư Nhập cư EB-5 cho phép nhà đầu tư có được thường trú nhân Hoa Kỳ (Thẻ xanh). Khoản đầu tư bắt buộc là 900,000 USD trong Khu vực mục tiêu việc làm (TEA) và 1,8 triệu USD bên ngoài TEA. Phán quyết thay đổi điều này trở lại các yêu cầu đầu tư trước tháng 11 tương ứng là 500.000 USD và 1 triệu USD. Một gia đình có thể nhận thị thực theo một khoản đầu tư miễn là trẻ em dưới 21 tuổi tại thời điểm họ nhận được Thẻ xanh có điều kiện – không phải ở thời điểm nộp đơn hoặc được chấp thuận.

Biden Reverses Trump-era Policy on Visa Rejection Procedure

Immigration officers can no longer reject visa applications without first issuing a Notice of Intent to Deny

In 2018, the Trump administration set a policy that would allow immigration officers to reject visa applications for visas such as the H1-B Visas, L-1 Visas, H-2B, J-1, J-2, I, F and O-1 visas, without issuing a Notice of Intent to Deny. This Trump-era policy invalidated the principle of a June 2013 USCIS memo that required immigration officers to issue a Request For Evidence or a Notice Of Intent to Deny when the case suggests that additional or supplementary evidence could potentially establish eligibility for an immigration benefit. 

The United States Citizenship and Immigration Services (USCIS) released a statement that it was returning to the principles of the June 2013 memo. This means the officers will be allowed to request potential missing documents that could qualify a case. Furthermore, this move will not only help requesters get an “opportunity to correct innocent mistakes and unintentional omissions”, but also increase access to the US legal immigration system in general. 

This is not the first time that Biden has overturned immigration policies set by the Trump administration. In fact, right on the first day of his term, President Biden had announced several executive policy changes to the US immigration system, including suspending the construction of the wall at the Mexican border and reaffirming protections for DACA (Deferred Action for Childhood Arrivals)

Along with changing their guidance towards notice of intent to deny and requests for evidence, the USCIS issued a statement that they are also increasing the validity period for certain Employment Authorization Documents (EADs) from one year to two years. Increasing the validity for these documents will allow the USCIS to shift their limited resources to priority areas, as it is projected to reduce the number of employment authorisation requests they receive. 

These recent decisions are all steps in the direction the Biden-Harris administration promised at the start of their term in an effort to make immigration to the US easier and fairer and eliminate unnecessary barriers on all levels; as put by the Secretary of Homeland security Alejandro N. Mayorkas: “We are taking action to eliminate policies that fail to promote access to the legal immigration system and will continue to make improvements that help individuals navigate the path to citizenship, and that modernise our immigration system”. 

In furtherance to the same, Acting USCIS Director also said “These policy measures are consistent with the Biden-Harris administration’s priorities to eliminate unnecessary barriers to our nation’s legal immigration system and reduce burdens on non-citizens who may be eligible for immigration benefits”.

While this action is in the right direction, the Biden-Harris administration has far to go before the US legal immigration system is not as congested and inefficient as it is currently. 

What is the L-1 Visa?

* The L-1 visa is a non-immigrant visa, which can be used by active US employers or those who wish to establish in the US to send experienced and skilled employees from overseas to the US to grow or expand the business. There are two types of this temporary work visa – the L-1A is for executives and managers, and the L-1B visa is suited for high-level employees with specialised knowledge. 

What is the O-1 Visa?

The O-1 visa on the other hand, requires the applicant to show remarkable skill or high levels of achievement in their field to be able to qualify. This is also a nonimmigrant visa, and is suitable for candidates that possess and demonstrate an extraordinary ability in science, the arts, education, business, athletics, or film & television and a variety of other professions. This means that a candidate must have sustained national or international acclaim in their field, or a distinction or record of extraordinary achievement in film and television. An O-1 beneficiary must possess either a major, internationally recognized award, such as the Nobel Prize; or at least 3 of the alternative criteria.

LGBTQ+ Asylum in the United States: Munisha & Shivjot’s Stories

Davies & Associates proudly represents LGBTQ+ clients in asylum cases and with deportation defense. While huge strides have been made in the United States, same sex relationships remain criminalized in dozens of countries worldwide. Even in countries where same sex relationships are not outlawed, LGBTQ+ individuals also face discrimination or persecution. In some countries members of the LGBTQ+ community face the Death Penalty.

Grounds for Asylum in United States

The United States has five categories as grounds for asylum claims:

  • Race
  • Religion
  • Nationality
  • Membership in a particular social group
  • Political opinion

LGBTQ+ falls under “membership of a particular social group” when it comes to asylum – even if that is not the most appropriate way to categorize human sexuality. Thousands of LGBTQ+ individuals have found a safe haven in America through the asylum system over the past three decades.

Munisha story

We are currently working with 33-year-old Munisha, a gay woman from India who is seeking asylum in the United States. She has been disowned by her family and has received death threats from a girlfriend’s family. She flew to the US on a tourist visa and claimed asylum and is being assisted by our asylum team led by Deepak Ahluwalia. In fleeing, she had to leave behind a son from an arranged marriage and misses him terribly. Now 14 years old, she has not seen him in three years except over video calls. She longs to be granted asylum and to be reunited with him.

Shivjot’s Story

Shivjot had been bullied all throughout her life for being a homosexual. From elementary school to college she has been harassed, blackmailed, and even threatened by her classmates to expose her sexuality to her parents and others. Despite moving away to a bigger city in hopes of living in a more understanding and modern environment for her sexuality, Shivjot experienced the enormous amount of hate. Shivjot had tried to live life in the city without gathering any attention to her; she only attended a couple of pride events but never showed any sign of intimacy with her girlfriend in public. But the public was wary and the smallest actions such as her holding hands with other women, or hugging other women, and attending pride events led to her being physically and sexually assaulted numerous times at the hands of the police. This is why she had to escape to America in hopes of being able to live her life freely.

EB-5 Investor Visa at $500,000 – Court Ruling

A federal judge ruled last night that one of the heads of the Department of Homeland Security under President Trump was not properly appointed, thus invalidating the EB-5 price increase from USD 500,000 to USD 900,000 in November 2019.

Within hours of the court decision, our firm received scores of inquiries from potential EB-5 investors who are hoping to avail themselves of the opportunity to invest in an EB5 qualifying project at USD 500,000.  

While a window now potentially exists until June 30th when the current Regional Center program expires, the next 24 to 48 hours are crucial as a response from USCIS is anticipated.

The anticipated response from USCIS could include filing an appeal or taking other administrative actions to close the new USD 500,000 window. Our clients who prepared EB-5 cases in the last few weeks may now be able to file their EB-5 case at USD 500,000, while others may not be able to given the timeframe and contingencies involved.

This also re-raises the question of responsible partial filing.  If carefully structured using escrow accounts and special fixed deposit accounts – that only allow for maturing funds to be remitted to the Regional Center – partial funding can be executed in a low-risk manner.

What is EB-5 Investor Visa?

The EB-5 Immigrant Investor Visa Program allows an investor to obtain US permanent residency (Green Card). The required investment was $900,000 in a Targeted Employment Area and $1.8 million outside of a TEA. The ruling changes this back to the pre November investment requirements of $500,000 and $1 million respectively. A family can receive visas under one investment provided the children are under the age of 21 at the point they receive a conditional Green Card – not at the point of submitting the application or having it approved.

It is possible to make and manage the investment yourself through so-called Direct EB-5. But the vast majority of applicants opt to invest through a Regional Center. A reputable RC with a good project can help to mitigate risks to both your Green Card and the return of your invested capital. Complying with the EB-5 rules can be tough for Direct EB-5 because you are required to create and sustain ten full-time jobs. Regional Centers are permitted a different job creation metric and use the funds for job-hungry projects.

The EB-5 Regional Center program is set to expire at the end of June 2021. Congress must reauthorize the process. There are competing vision for reform, which is causing legislative friction. Compromise is needed if Congress is to reauthorize a program that brings millions of dollars of investment and creates hundreds of thousands of jobs. Direct EB-5 remains unaffected.

Bộ Ngoại giao đã công bố bản tin thị thực tháng 7 năm 2021 cho thấy có sự chuyển biến tích cực trong quá trình xử lý hồ sơ của Nhà đầu tư , đặc biệt đối với Nhà đầu tư Việt Nam so với Bản tin thị thực tháng 6/2021 và tháng 5/2021 đều ít chuyển biến với Ngày hành động cuối cùng là năm 2018.
Cụ thể, “Ngày hành động cuối cùng” cho hồ sơ EB5-Trực tiếp (Nhà đầu tư tự thực hiện và quản lý khoản đầu tư) dành cho Nhà đầu tư Việt Nam đã tiến tới ngày 01/04/2020.
Có một điểm khác lạ trong bảng tin thị thực tháng 7 so với tháng 6 về trạng tháng của “Ngày hành động cuối cùng” chương trình EB-5 Trung tâm Vùng đã chuyển thành U (unothorized) cho tất cả các quốc gia.
Tuy nhiên, việc này được giải thích vì chương trình EB-5 thông qua Trung tâm Vùng sẽ được gia hạn lại vào ngày 30/06/2021 sắp tới như cách nó đã được gia hạn trong những năm qua kể từ khi được thông qua vào năm 1990.
 
Tham khảo lại các bảng tin thị thực các tháng trước đây, ta dễ dàng nhận thấy, “Ngày hành động cuối cùng” của cả hai chương trình EB-5 (Trực tiếp và Trung tâm Vùng) thông thường đều có cùng một mốc thời gian. Vì vậy, Nhà đầu tư có thể tin tưởng và hy vọng rằng Ngày hành động cuối cùng của EB5 Trung tâm Vùng sẽ cùng ngày 01/04/2020 với EB5 Trực tiếp..
 
Đây là một tín hiệu đáng mừng cho các Nhà đầu tư vẫn còn đang phân vân về tiến độ xử lý và thời gian chờ của EB-5. Nếu việc gia hạn chương trình EB5 – Trung tâm Vùng được thông qua. Liệu đây có phải tín hiệu cho thấy động thái của Hoa Kỳ tái khởi động lại chương trình sau khi được gia hạn lại vào ngày 30/06/2021.

Chính quyền Biden đã khởi động lại Chương trình dành riêng cho Doanh nhân Quốc tế (INTERNATIONAL ENTREPRENEUR PAROLE – IEP). Cá nhân nào đủ điều kiện cho chương trình IEP?
 
Như tên cho thấy Chương trình đặc cách Doanh nhân Quốc tế dành cho tất cả doanh nhân toàn cầu, nhưng tính đủ điều kiện cuối cùng sẽ được Bộ An ninh Nội địa (DHS) xác định trên cơ sở theo từng trường hợp.
 

Các yêu cầu cơ bản về tính đủ điều kiện bao gồm:Doanh nghiệp phải là một công ty khởi nghiệp, được thành lập trong vòng năm (5) năm qua tại Hoa KỳNgười nộp đơn phải có “Quyền sở hữu đáng kể” trong doanh nghiệp khởi nghiệpNgười nộp đơn phải đóng một vai trò tích cực trong doanh nghiệpDoanh nghiệp phải đảm bảo nguồn vốn đáng tin cậy hoặc nguồn hỗ trợ có thể chứng minh khác từ các nhà đầu tư tư nhân Hoa Kỳ, hoặc các tổ chức liên bang, tiểu bang và địa phương.
Thời hạn được cấp của chương trình IEP trong bao lâu?
 
Chương trình Đặc cách cho Doanh nhân Quốc tế ban đầu có hiệu lực tối đa 30 tháng. Có thể được gia hạn thêm 30 tháng với điều kiện doanh nghiệp có thể chứng minh rằng họ đã phát triển và tạo ra việc làm.
Tuy nhiên, chương trình đặc cách này không phải là một thị thực và những người muốn ở lại Hoa Kỳ lâu hơn sẽ cần phải lên kế hoạch cẩn thận cho các lựa chọn của họ. Bất kỳ cá nhân nào từ Quốc gia thuộc Hiệp ước E-2 đều có khả năng chuyển đổi sang Thị thực Nhà đầu tư Hiệp ước E-2.

Đúng. Vợ/chồng và con cái có thể đi cùng với đương đơn chính đến Hoa Kỳ theo Chương trình Doanh nhân Quốc tế. Vợ/chồng có thể nộp xin được phép đi làm.
Người nộp đơn chính chỉ có thể làm việc cho công ty khởi nghiệp và không đủ điều kiện để làm việc ở những nơi khác trên Hoa Kỳ.
 
Có bao nhiêu doanh nhân có thể được cấp cho Doanh nhân Quốc tế theo Chương trình này?
 
Số lượng doanh nhân tối đa có thể nộp đơn cho mỗi doanh nghiệp khởi nghiệp là ba (3) cá nhân.
 
Có phải Chương trình Đặc cách cho Doanh nhân Quốc tế chỉ dành cho các Công ty khởi nghiệp Công nghệ cao không?
 
Không. Chương trình Đặc cách cho Doanh nhân Quốc tế dành cho bất kỳ doanh nghiệp khởi nghiệp nào trong bất kỳ lĩnh vực công nghiệp nào. Miễn là nó đáp ứng các tiêu chí chính và có thể chứng minh rằng nó mang lại tiềm năng tăng trưởng mạnh mẽ và tạo việc làm ở Hoa Kỳ.
 
Những quốc gia nào đủ điều kiện cho Chương trình Đặc cách cho Doanh nhân Quốc tế?
 
Chương trình Đặc cách cho Doanh nhân Quốc tế dành cho mọi người từ tất cả các quốc gia trừ khi có các biện pháp trừng phạt hoặc hạn chế cụ thể ảnh hưởng đến tất cả các hình thức nhập cư giữa quốc gia của bạn và Hoa Kỳ. Điều này có nghĩa là Chương trình Đặc cách cho Doanh nhân Quốc tế tiếp cận rộng rãi hơn với Thị thực Nhà đầu tư Hiệp ước E-2, có nhiều lợi thế hơn nhưng chỉ giới hạn cho những người từ các Quốc gia Hiệp ước.
 
So sánh Chương trình Đặc cách cho Doanh nhân Quốc tế so sánh với Thị thực Nhà đầu tư Hiệp ước E-2.
 
Thị thực Nhà đầu tư theo Hiệp ước E-2 cho phép người nộp đơn đầu tư và điều hành doanh nghiệp tại Hoa Kỳ. Một trong những lợi thế chính của nó so với Chương trình Đặc cách cho Doanh nhân Quốc tế là khoảng thời gian bạn có thể ở lại Hoa Kỳ. Mặc dù Chương trình đặc cách cho Doanh nhân Quốc tế được giới hạn trong 30 tháng và thêm 30 tháng cho các doanh nhân có thể chứng tỏ sự phát triển.
Thị thực E-2 có thể gia hạn mãi mãi với điều kiện doanh nghiệp E-2 tiếp tục hoạt động thành công. Giống như chương trình IEP, Visa E-2 cần được gia hạn và xem xét lại, nhưng các doanh nhân thường có thời gian lâu hơn. Hiệu lực thực tế của Thị thực E-2 ban đầu của bạn phụ thuộc vào nơi bạn đến – mỗi quốc gia có thời hạn hiệu lực riêng được nêu chi tiết theo nguyên tắc có đi có lại của Bộ Ngoại giao.
 
Ưu điểm của chương trình IEP so với Thị thực đầu tư theo Hiệp ước E-2 là thị thực E-2 chỉ dành cho những người đến từ các Quốc gia thuộc Hiệp ước E-2. Chương trình Đặc cách cho Doanh nhân Quốc tế có thể là một giải pháp thay thế nếu bạn không đến từ quốc gia Hiệp ước E-2.
Tuy nhiên, cũng có một giải pháp khác: Tính đủ điều kiện của Thị thực E-2 được xác định bởi quốc tịch, vì vậy có thể nhập quốc tịch của Quốc gia thuộc Hiệp ước E-2 và đủ điều kiện để được cấp thị thực.
Các cách nhanh nhất và tiết kiệm chi phí nhất để trở thành công dân của một Quốc gia thuộc Hiệp ước E-2 là Chương trình Đầu tư Quốc tịch Grenada và Chương trình Đầu tư Quốc tịch Thổ Nhĩ Kỳ.
 
Chương trình Đặc cách Doanh nhân Quốc tế (IEP) So sánh với Thị thực L-1 như thế nào?
 
Một thay thế khác cho Chương trình Đặc cách cho Doanh nhân Quốc tế là Visa L-1.
Thị thực L-1 cho phép chuyển giao nhân viên trong cùng một công ty, L-1A dành cho các Nhà quản lý & Giám đốc điều hành Quốc tế và L-1B dành cho những nhân viên có tay nghề cao với kiến thức chuyên môn. Công ty của chúng tôi chuyên về Thị thực L-1 Văn phòng Mới, nơi bạn thiết lập một văn phòng mới tại Hoa Kỳ của công ty mình và chuyển một nhân viên đến Hoa Kỳ để giám sát sự khởi động và tăng trưởng của công ty đó.

E-2 Extension Approved Despite Sluggish Performance in Pandemic

Two years ago, D&A assisted an investor from Jordan obtain an E2 Treaty Visa through his investment in a furniture business. He applied to change of status after he entered the U.S. on a visitor visa. With the change of status application, he did not have to appear for interview at the Embassy which made more sense to him since he wanted to immediately operate the business and considering that the reciprocity schedule for Jordanian nationals is only 3 months. His spouse and dependent children thereafter applied for their visas at the Embassy to join him in the U.S.

While the first year and six months were not very good for the E-2 company, D&A managed to secure an extension of status for the client. While things became much harder in the first few months of the pandemic due to store shutdowns and stay-at-home orders,  retail sales rebounded strongly due to sustained consumer resilience.

Extension of Status Approval

D&A highlighted the record percentage increase in sales in 2020 to convince USCIS that the Company is very much poised to achieve the forecasts in the business plan submitted with the initial petition. D&A emphasized the strong stock market, rising home values and record savings boosted by government stimulus payments in 2020 to assert that the Company is slowly but surely moving the path of attaining goals that is expected to ultimately result in positive contributions to the US economy, specifically in the area of employment generation.

While it was certainly not easy to get the E-2 status extended, it pays to have an experienced team on your side to present your application in the best light possible to get a favorable decision from USCIS.

What is the E-2 Treaty Investor Visa?

The E-2 Visa allows anyone with citizenship of an E-2 Treaty Country to apply to move to the United States to invest in and run a business. Anyone not from a Treaty Country can first obtain citizenship of a Treaty Country and become eligible in this way. See Grenada Citizenship by Investment and Turkey Citizenship by Investment. The E-2 Visa application process requires the submission of a credible business plan and renewals are granted on the basis of performance against that business plan.

Italian Residency

The most popular Italian visa category for our firm is the Elective Residency Visa. To apply you need to be able to prove you have at least €32,000/year in funds earned outside of Italy and a place to stay. An alternative pathway to residency is through investment – the Italian government slashed the prices of its Investor Visa last year and now options start from $250,000. A new tax system designed to attract High Net Worth Individuals and retirees as well as self-employed workers was introduced three years ago.

Italian Citizenship

After ten years’ residency a person can apply for Italian citizenship (2 years for EU citizens and a less clear picture for British post-Brexit). An alternative path to Italian citizenship is through lineage. If you are able to prove you have an Italian ancestor you may be eligible for citizenship. This option is especially popular in Latin America – Brazil, Argentina, Venezuela – because of considerable Italian migrant exodus in the early twentieth century.

The Future of EB-5 Investor Visa: Webinar Recording

Last Friday we hosted a webinar on the EB-5 Immigration Investor Visa at a crucial time in the program’s history. The Webinar, titled “The Future of EB-5” featured key experts from the industry weighing in on the outlook for the program.

The EB-5 Investor Visa Regional Center Program is facing reauthorization before the end of June – this just refers to investments through the Regional Center program, Direct EB-5 (where the applicant makes and manages the investment themselves) is unaffected.

Watch our panelists debate the probability of reauthorization and the possibility of a temporary lapse if Congress cannot pass legislation in time. They detail the reform proposals in the EB-5 Reform and Integrity Act in the Senate, as well the potential need to compromise with a rival bill.

Also discussed is the possibility of the investment amount lowering from USD 900,000 to USD 500,000 because of a lawsuit currently working its way through the California courts. The premise is that the 2019 price increase was illegal because Trump’s Department for Homeland Security DHS chief was improperly appointed.


The expert panel also answer a range of questions from more than 100 people who participated.
